Below you will find our General Terms and Conditions. These apply whenever you use or place an order through our Website and contain important information for you as a buyer. Please read the General Terms and Conditions carefully. We also recommend saving or printing these terms so you can review them at a later time.
Article 3. Prices and Information
3.1 All prices stated on the Website and in other materials originating from Motorparts-online.com include VAT and, unless stated otherwise on the Website, other levies imposed by the government.
3.2 If shipping costs are charged, this will be clearly stated well before the Agreement is concluded. In addition, these costs will be displayed separately in the ordering process.
3.3 The content of the Website has been compiled with the greatest care. However, Motorparts-online.com cannot guarantee that all information on the website is correct and complete at all times and is therefore not liable for this.
3.4 All prices and other information on the Website and in other materials originating from Motorparts-online.com are subject to obvious programming and typing errors. Motorparts-online.com is not liable for displaying incorrect prices which the Customer may assume are obviously incorrect. If the Customer discovers that incorrect prices are stated, the Customer has the opportunity to report this to Motorparts-online.com.
3.5 Motorparts-online.com cannot be held responsible for (color) deviations due to screen quality.
Article 4. Conclusion of the Agreement
4.1 The Agreement is concluded at the moment the Customer accepts the offer of Motorparts-online.com and meets the conditions set by Motorparts-online.com.
4.2 If the Customer has accepted the offer electronically, Motorparts-online.com will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Customer has the option to dissolve the Agreement.
4.3 If it transpires that incorrect details were provided by the Customer when accepting or otherwise entering into the Agreement, Motorparts-online.com has the right to fulfill its obligation only after the correct details have been received.
4.4 Insofar as rights and obligations apply when entering into a Distance Agreement, Motorparts-online.com is responsible for compliance with these rules regarding the Agreement between Motorparts-online.com and the Customer.
4.5 Motorparts-online.com may, within legal frameworks, ascertain whether the Customer can meet their payment obligations, as well as all facts and factors that are relevant to a responsible conclusion of the Agreement. If Motorparts-online.com, based on this investigation, has good reasons not to enter into the Agreement, it is entitled to refuse an order or application with reasons, or to attach special conditions to the execution, such as advance payment.
Article 5. Execution of the Agreement
5.1 As soon as the order has been received by Motorparts-online.com, Motorparts-online.com will send the products as soon as possible, subject to the provisions of paragraph 3 of this article.
5.2 Motorparts-online.com and the Merchant are entitled to engage third parties to fulfill the obligations arising from the Agreement.
5.3 The Website clearly describes, well before the conclusion of the Agreement, how delivery will take place and within what timeframe the products will be delivered. If no delivery period has been agreed upon or specified, products will in any case be delivered within 30 days.
5.4 If Motorparts-online.com cannot deliver the products within the agreed timeframe, it will inform the Customer accordingly. In that case, the Customer can agree to a new delivery date or is given the option to dissolve the Agreement free of charge.
5.5 Motorparts-online.com advises the Customer to inspect the delivered products and to report any defects discovered within a reasonable time, preferably in writing or by email. See further the article regarding warranty and conformity.
5.6 As soon as the products to be delivered have been delivered to the specified delivery address, the risk concerning these products transfers to the Customer. If explicitly agreed otherwise, the risk transfers to the Customer earlier. If the Customer decides to pick up the products, the risk transfers upon handover of the products.
5.7 Motorparts-online.com is entitled to deliver a similar product of similar quality to the product ordered if the ordered product is no longer available. The Customer is then entitled to dissolve the agreement free of charge and return the product free of charge.
Article 6. Right of Withdrawal / Returns
6.1 This article only applies if the Customer is a natural person not acting in the exercise of their profession or business. Business Customers therefore do not have a right of withdrawal. The Customer has the right to dissolve the distance Agreement concluded with Motorparts-online.com within 14 calendar days after receipt of the product, without giving reasons, free of charge. The period begins on the day after the Customer, or a third party designated by them in advance who is not the carrier, has received the product, or: · if the Customer has ordered multiple products in the same order: the day on which the Customer, or a third party designated by them, received the last product; · if the delivery of a product consists of several shipments or parts: the day on which the Customer, or a third party designated by them, received the last shipment or part;
6.2 Only the direct costs for the return shipment are for the account of the Customer. The Customer must therefore bear the return costs themselves. If these costs are higher than the standard postal rate, Motorparts-online.com will provide an estimate of these costs.
6.3 Within the withdrawal period referred to in paragraph 1, the Customer
6.4 The Customer is only liable for any reduction in value of the product resulting from handling the product beyond what is permitted in the previous paragraph.
6.5 The Customer can dissolve the Agreement in accordance with paragraph 1 within the period set in this article by sending the model withdrawal form (digitally) to Motorparts-online.com, or by making it known to Motorparts-online.com in another unambiguous manner that they waive the purchase. Motorparts-online.com will confirm receipt of a digital notification. After dissolution, the Customer has 14 days to return the product. It is also possible to return the product directly within the cooling-off period set out in paragraph 1 of this article, provided that the model withdrawal form or another unambiguous statement for withdrawal is enclosed.

6.6 Amounts already paid in advance by the Customer will be refunded to the Customer as soon as possible, but no later than 14 days after the dissolution of the Agreement, using the same method that the Customer used to pay for the order. If the Customer opted for a more expensive delivery method than the cheapest standard delivery, Motorparts-online.com is not required to refund the additional costs for the more expensive method. Unless Motorparts-online.com offers to collect the product itself, Motorparts-online.com may withhold the refund until Motorparts-online.com has received the product, or until the Customer demonstrates that they have returned the product, whichever occurs first.
6.7 Information regarding whether or not the right of withdrawal applies, along with any required procedure, will be clearly stated on the Website well before the conclusion of the Agreement.
Article 7. Payment
7.1 The Customer must make payments to Motorparts-online.com according to the payment methods indicated during the ordering process and optionally on the Website. Motorparts-online.com is free to choose the offered payment methods, and these may change from time to time. In the case of payment after delivery, the Customer has a payment period of 14 days starting on the day after delivery.
7.2 If the Customer fails to meet their payment obligation(s) in a timely manner, and after Motorparts-online.com has notified them of the late payment and granted a period of 14 days to still fulfill their payment obligations, the Customer will owe statutory interest on the outstanding amount upon failure to pay within this 14-day period. Motorparts-online.com will then also be entitled to charge any extrajudicial collection costs incurred.
These collection costs amount to a maximum of:
15% on outstanding amounts up to €2,500;
10% on the subsequent €2,500;
5% on the next €5,000, with a minimum of €40.
Motorparts-online.com may deviate from the aforementioned amounts and percentages in favor of the Customer.
Article 8. Warranty and Conformity
8.1 This article only applies if the Customer is a person not acting in the exercise of their profession or business. If a separate warranty on the products is provided by Motorparts-online.com, this applies to all types of Customers, without prejudice to what was just stated.
8.2 The Merchant guarantees that the products comply with the Agreement, the specifications stated in the offer, reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations existing on the date the agreement was concluded. If specifically agreed, the Merchant also guarantees that the product is suitable for other than normal use.
8.3 Any warranty provided by Motorparts-online.com, the Merchant, manufacturer, or importer does not affect the legal rights and claims that the Customer already has and can invoke under the Agreement.
8.4 If the delivered product does not comply with the Agreement, the Customer must notify Motorparts-online.com within a reasonable period after discovering the defect.
8.5 If Motorparts-online.com deems the complaint well-founded, the relevant products will be repaired, replaced, or reimbursed after consultation with the Customer. The maximum reimbursement, subject to the Article regarding liability, is equal to the price paid by the Customer for the product.
Article 9. Complaints Procedure
9.1 If the Customer has a complaint about a product (in accordance with Article 8 regarding warranty and conformity) and/or about other aspects of the services of Motorparts-online.com, they can submit a complaint to Motorparts-online.com by telephone, email, or post. See the contact details at the bottom of the General Terms and Conditions.
9.2 Motorparts-online.com will respond to the Customer's complaint as soon as possible, but in any case within 14 days of receiving the complaint. If it is not yet possible to provide a substantive or final response, Motorparts-online.com will confirm receipt within 14 days of receiving the complaint and provide an indication of the period within which it expects to give a substantive or final response to the Customer's complaint.
Article 10. Liability
10.1 This article only applies if the Customer is a natural or legal person acting in the exercise of their profession or business.
10.2 The total liability of Motorparts-online.com towards the Customer due to an attributable failure in the performance of the Agreement is limited to compensation of at most the amount of the price agreed for that Agreement (including VAT).
10.3 The liability of Motorparts-online.com towards the Customer for indirect damages, including—but explicitly not limited to—consequential damages, lost profits, lost savings, loss of data, and damage due to business interruption, is excluded.
10.4 Outside the cases mentioned in the previous two paragraphs of this article, Motorparts-online.com incurs no liability whatsoever towards the Customer for compensation, regardless of the grounds on which an action for compensation would be based. However, the restrictions mentioned in this article will lapse if and to the extent that the damage is the result of intent or gross negligence on the part of Motorparts-online.com.
10.5 The liability of Motorparts-online.com towards the Customer due to an attributable failure in the performance of an agreement only arises if the Customer places Motorparts-online.com in default promptly and properly in writing, granting a reasonable period to remedy the failure, and Motorparts-online.com continues to fail in the performance of its obligations after that period. The notice of default must contain as detailed a description of the failure as possible, so that Motorparts-online.com is able to respond adequately.
10.6 A condition for any right to compensation to arise is always that the Customer reports the damage in writing to Motorparts-online.com as soon as possible, but no later than 30 days after it arises.
10.7 In the event of force majeure, Motorparts-online.com is not required to compensate for any damage incurred by the Customer as a result.
Article 11. Retention of Title
11.1 As long as the Customer has not made full payment for the entire agreed amount, all delivered goods remain the property of the Merchant.
Article 12. Personal Data
12.1 Motorparts-online.com processes the personal data of the Customer in accordance with the privacy statement published on the Website.
12.2 The personal data that Motorparts-online.com obtains from Customers will only be used for the execution of the Agreement and to make offers for similar products and services.
12.3 For the purpose of executing the Agreement, Motorparts-online.com may share personal data with the Merchant.
Article 13. Final Provisions
13.1 Dutch law applies to the Agreement.
13.2 Insofar as mandatory law rules do not prescribe otherwise, all disputes that may arise as a result of the Agreement will be submitted to the competent Dutch court in the district where Motorparts-online.com is established.
13.3 If a provision in these General Terms and Conditions turns out to be void, this does not affect the validity of the entire General Terms and Conditions. In that case, the parties will establish new provision(s) as a replacement, giving shape to the intention of the original provision as much as legally possible.
13.4 In these General Terms and Conditions, "in writing" also includes communication by email and fax, provided that the identity of the sender and the integrity of the email are sufficiently established.
